Terms of Service

These Terms of Service govern your access to and use of the MyBabyGuessr service, available at mybabyguessr.com. By using this service, you agree to these terms without reservation.

Article 1 — About MyBabyGuessr

MyBabyGuessr is an online service that allows expectant parents to create a baby guessing game. Friends and family can participate by guessing the name, gender, due date, weight and/or height of the baby, via a simple invitation link — no account required to play.

Article 3 — Access

The service is freely accessible from any web browser. Creating a game requires registering an account (email + password). Participating in a game requires no account — only the invitation link shared by the organizer.

The service is intended for adults, or minors with parental authorization.

Article 4 — User Account

4.1 — Creating a game requires registering with a valid email address, first name, last name, and password. A verification email is sent upon registration.

4.2 — You are solely responsible for the confidentiality of your credentials. Any unauthorized use of your account must be reported immediately to contact@mybabyguessr.com.

4.3 — You may delete your account at any time directly from your account settings (section "Delete my account"), or by contacting us at contact@mybabyguessr.com. Deletion is immediate, permanent, and removes all associated games and data.

4.4 — Accounts inactive for more than 24 months may be deleted after prior email notice.

4.5 — You may update your profile information (first name, last name), change your email address (confirmed via a link sent to the new address), and update your password at any time from your account settings.

Article 5 — How the Service Works

5.1 — The organizer creates a game by selecting categories (gender, name, date, weight, height), setting a title, an expected due date, and optionally uploading a cover photo.

5.2 — Players access the game via the unique link shared by the organizer and submit their guesses. They may optionally provide an email address to receive the reveal notification.

5.3 — The organizer can close the game at any time, reveal the true answers, and notify players who provided their email address.

5.4 — The service is provided as-is, without warranty of any specific result or feature availability.

Article 6 — User Content

6.1 — You may upload a cover photo for your game. By doing so, you certify that you hold all necessary rights to that image and that it does not infringe any third-party rights.

6.2 — MyBabyGuessr acquires no ownership over uploaded content. You retain all rights to your images.

6.3 — Images are used solely to display the game to invited participants and are not shared with third parties.

6.4 — Any unlawful or offensive content will be removed without notice.

Article 7 — Prohibited Uses

You may not:

• Use the service for commercial, advertising, or solicitation purposes;
• Attempt to access other users' data or bypass security mechanisms;
• Post hateful, offensive, discriminatory, or illegal content;
• Automate access to the service (scraping, bots, scripts) without prior written authorization;
• Attempt to harm the integrity or availability of the technical infrastructure;
• Impersonate another person or entity;
• Share links to malicious content.

Any breach of these rules may result in immediate account suspension or deletion.

Article 8 — Intellectual Property

The name "MyBabyGuessr", the logo, visual design, and source code are the exclusive property of Atif Mickaël Zourgani and are protected by intellectual property laws. Any reproduction, distribution, or use, even partial, without prior written authorization is strictly prohibited.

Article 9 — Liability

MyBabyGuessr is a family and recreational service. The publisher strives to keep the service accessible and functional but cannot be held liable for:

• Service interruptions of technical origin or related to the hosting provider;
• Content published by users;
• Data loss resulting from unforeseeable events or force majeure;
• Indirect damages resulting from use or inability to use the service.

Article 10 — Availability

The service is provided without guarantee of continuous availability. Maintenance operations may be performed with or without advance notice depending on urgency. The publisher will endeavor to provide advance notice of significant planned interruptions.

Article 11 — Changes to These Terms

These terms may be updated at any time. For material changes affecting user rights, registered users will be notified by email at least 15 days before the new terms take effect. Continued use of the service after that date constitutes acceptance of the updated terms.

Article 12 — Governing Law

These terms are governed by French law. In the event of a dispute, the parties agree to seek an amicable resolution before initiating legal proceedings. Failing that, the competent French courts shall have exclusive jurisdiction.
